Tony Zendejas was recently charged with one count each of rape by use of drugs, rape of an unconscious person, sodomy by anesthesia or controlled substance and sodomy of an unconscious victim. Moving passed the fact that "sodomy by anesthesia" really doesn't make sense, I have a few questions regarding the charge sodomy of an unconscious victim ("SOAUV").

I haven't read the statute, but is SOAUV completely disallowed? Lets say I get permission to have sex (non-specific as to orifice) with someone if they drink themselves unconscious. Can I still be charged with SOAUV? What if I am specifically granted access to the hiney?

What if I put it in their mouth, like as a prank? Can I be charged with SOAUV?

Note: My hypotheticals refer to sodomizing females. Except maybe the last one.

I'm going to suggest to the authorities that they avoid the rush and arrest you now.
